So I won the lawsuit against SLIMBAND IN TORONTO how do i collect

GOOOD NEWS!!!

I directly contact to Jacquelin Palef from Lerners Lawyer firm in Toronto who interested to do Lawsuit class action against Slimband/ Allegran Inc. She is expertise defective medical devices and she had worked many class action. I spoke to her the phone personally and she mentioned she will take up to the board first to confirmed and then we go ahead from there. I would need hear back her from next following two week. Let keep our finger crossed.

Is anyone is in GTA or outside of GTA? Just forget to ask the lawyer if she can advocate client for Toronto or across Canada clients . I read her bio that he can represent USA and Canada clients.

I am very interested in going in on this class action lawsuit. Do I need to contact the lawyer to join? and if so, who do I contact. We have put out several thousands of dollars and need to get something for this scam.

Hi Ann,

So first Jacquelin Palef from Lerners Lawyer firm will take up to the board to confirmed then she will contact back me after two week to confirmed. Then once she created a class action in her website then you will put your name on the list and she will look into every each case. For now we need to keep our finger crossed once the board is on the board.

Hello,

I had followed up many law firm related lawsuit class action for medical default and personal injuries. Unfortunately Jacquelin Palef from Lerners Lawyer firm unable to take on this matter due to a conflict. Gold Batt Partners firm mentioned about to aware that in general a person in Ontario has to start a lawsuit within two years of the event harming them or the knowledge they were harmed. If you do not start your case within two years, the defendant may say your case it too late and is “statute barred. I had couple lawyer was interested then once they took up the board it was not good case i guess.. The lawyer asked to keep eyes on BC firm because at the moment the court isn't currently approved the case yet.

I wonder if Doctor in Hamilton would remove my band and have it covered by OHIP. I have asked my GP for a referral. I would also be interested in the recovery time

if you guys do end up finding someone to sue slimband, please let me know. I also got a band in 2011 and i havent lost any weight. it has also made my life miserable and ihavent had a refill as once they filled it soo much that i had to go to emergency. i just recently found out they closed shop. i talked to my doctor about having the band removed but was told unless it caused me some life threatening situation they cannot remove it. so i am stuck to wait until i am close to dying from the band before having it removed :( these 2 years rules and ohip rules does not take into consideration human rights/humanity :(

can you talk to the surgeon directly or do we need a referral from family doctor? my family doctor wont do it unless its considered life threatening to me

I didn’t need my doctor at all... and if you want the same then tell them about the experience you are having... it doesn’t cost anything it’s covered by OHIP... and the next day you can eat regularly without the horrible tension... I have been focusing on eating healthy and have managed to lose weight still.., if you have any other questions let me know :)

Hi Everyone,

I had finally received an email from Rosenberg Law.The action is in its beginning stages and there is still opportunity to become a class member and seek to receive compensation for the injuries.Rosenberg Law, is the lead counsel for this action. They will be arguing this case in court against the manufacturers and distributers of Lap-Band. their argument is that the defendants produced and marketed Lap-Band at a time when they knew Lap-Band was faulty, ineffective, and dangerous, and was causing serious injury to patients. The judge managing this case is Justice Warren Milman of the British Columbia Supreme Court.

They are working with the lawyers at Murphy Battista LLP to prosecute the Lap-Band action against the defendants. Kevin Gourlay is the lead lawyer at Murphy Battista working on this action. Kevin and Murphy Battista will be working with all class members to collect medical records and other information and to assist individuals in making their claim to any settlement fund or trial award.

@falgune i also finally received an email from them. They asked me to reply back with my email so they can verify my name and send my address. She said someone will be in touch with me soon, so waiting for that. I really hope this works out. I am so tired of getitng a bit of hope than nothing. im also scared about getting my band removed. im starting to have in my incision area but tests showed i had hernia and its not the band.

      Iʻm roughly 6 weeks post-op this morning and have begun to feel like a normal human, with a normal human body again. I started introducing solid foods and pill forms of medications/supplements a couple of weeks ago and it's really amazing to eat meals with my family again, despite the fact that my portions are so much smaller than theirs. 
      I live on the island of Oʻahu and spend a lot of time in the water- for exercise, for play,  and for spiritual & mental health. The day I had my month out appointment with my surgeon, I packed all my gear in my truck, anticipating his permission to get back in the ocean. The minute I walked out of that hospital I drove straight to the shore and got in that water. Hallelujah! My appointment was at 10 am. I didn't get home until after 5 pm. 
      I'm down 31 pounds since the day of surgery and 47 since my pre-op diet began, with that typical week long stall occurring at three weeks. I'm really starting to see some changes lately- some of my clothing is too big, some fits again. The most drastic changes I notice however are in my face. I've also noticed my endurance and flexibility increasing. I was really starting to be held up physically, and I'm so grateful that I'm seeing that turn around in such short order. 
      My general disposition lately is hopeful and motivated. The only thing that bugs me on a daily basis still is the way those supplements make my house smell. So stink! But I just bought a smell proof bag online that other people use to put their pot in. My house doesn't stink anymore.

      Oh yeah, something I wanted to rant about, a billing dispute that cropped up 3 months ago.
      Surgery was in August of 2023. A bill shows up for over $7,000 in January. WTF? I asks myself. I know that I jumped through all of the insurance hoops and verified this and triple checked that, as did the surgeon's office. All was set, and I paid all of the known costs before surgery.
      A looong story short, is that an assistant surgeon that was in the process of accepting money from my insurance company touched me while I was under anesthesia. That is what the bill was for. But hey, guess what? Some federal legislation was enacted last year to help patients out when they cannot consent to being touched by someone out of their insurance network. These types of bills fall under something called, "surprise billing," and you don't have to put up with it.

      I had to make a lot of phone calls to both the surgeon's office and the insurance company and explain my rights and what the maximum out of pocket costs were that I could be liable for. Also had to remind them that it isn't my place to be taking care of all of this and that I was going to escalate things if they could not play nice with one another.
      Quick ending is that I don't have to pay that $7,000+. Advocate, advocate, advocate for yourself no matter how long it takes and learn more about this law if you are ever hit with a surprise bill.

      Thank you everyone for your well wishes! I totally forgot I wrote an update here... I'm one week post op today. I gained 15 lbs in water weight overnight because they had to give me tons of fluids to bring my BP up after surgery! I stayed one night in the hospital. Everything has been fine except I seem to have picked up a bug while I was there and I've been running a low grade fever, coughing, and a sore throat. So I've been hydrating well and sleeping a ton. So far the Covid tests are negative.
      I haven't been able to advance my diet past purees. Everything I eat other than tofu makes me choke and feels like trying to swallow rocks. They warned me it would get worse before it gets better, so lets hope this is all normal. I have my follow up on Monday so we'll see. Living on shakes and soup again is not fun. I had enough of them the first time!! LOL

      Still purging all of the larger clothing. This morning, a shirt that I ADORED wearing ended up on top. Hard to let it go, but it was also hard to let go of those habits that also no longer serve my highest good. Onward and upward!
