So I won the lawsuit against SLIMBAND IN TORONTO how do i collect

Recommended Posts

So to make a very long story short, I paid 16,000 dollars to the SLIMMBAND CLINIC IN TORONTO, TO INSERT BY LAPOROROCOPY AND GENERAL ANESTHETIC A DEVICE WHICH WAS TO CONTROL MY APPETITE AND HELP ME TO LOSE AND MAINTAIN MY WEIGHT, FOR MY HEALTH.

I was blind sighted, I should have done my homework, this very clinic and doctor had jumped ship on hundreds of other innocent unsuspecting, patients. I went through the courts and won the case against the clinic, big deal they shut their doors one week prior to my court date.

My only hope is to tell anyone who even thinks about this way of life in the Toronto area be certain it is not the same owner, nor the same doctor that took my money and left me with a nonfunctioning piece of silicone band in my abdomen. Three surgeries later and many heart aches and physical discomfort I had the monster removed.DO NOT BE FOOLED THEY HIRE SKINNY PEOPLE WHO TELL YOU THEY HAD THE SAME SURGERY. I HAVE ASLO BEEN IN CONTACT WITH PATIENTS THAT ENDED UP WITH SEVERE INFECTIONS AND MANY COMPLICATIONS.

I would love to chat with you, so happy you went after them, they need to be held responsible. This has truly been the biggest mistake of my life. So much pain and suffering and no care, no support....abandoned!

How can this happen?

I have had the surgery too. I lost 143 pounds. By not eating and vomiting ALOT

I was thinking I was eating too much at once. 3 crackers and a piece of marble cheese did it for me one day. I would be at work and sick. It was getting to be awful. So after 7 years I had the band removed, I was putting weight back on anyway. I feel better, although I am gaining weight. I would like to know who you went to as a lawyer. I do not care about a lot of money, really just want my $16000.00 back. This was to be a life long commitment and after 7 years I am done!!! Please help! I hope you got your money!

I think a class action lawsuit should be filed to covered the cost of removal and the pain and suffering that patients have gone through. Would anybody know how to get that started?

Yes it would be nice to get a refund , that would at least help cover the revision costs but its unlikely to happen

I did a quick Google search about this. Man! I can't believe that **** weasel of a butcher is still practicing medicine! He is foul! If I were a terrible person I'd wish he's meet a butcher of equal evil in a dark alley. Oh wait I'm not good, I'm Sin! Yay! Now I can hope he gets a lobotomy!

Hi There, I'm glad you won your case. Did you go to Small Claims? So all doctors have to have errors and omission insurance which lawsuits fall under. So I would think that they would be required to pay you out of that. I;m thinking that the company name, and all Dr's that are partners in the company are named personally.

I had a lapband performed Dec 2007. I lost over 250 pounds in total during my time but I was never able to get a fill. I would throw up for days and have to go back and have it unfilled. I mainly drank Protein Shakes, Water and exercised non stop. The clinic never returned calls. And Two years ago I had to have my band remove because it has destroyed my esophagus so badly and I was constanly bleeding internally and my hemoglobin had hit so low that I was going weeks not able to get out of bed. Dr. Yau was suspended after and sold the Lapband Clinic to Slimband but apparently kept performing and working there. I have spent so much money and lost so much money because of being self employed and not being able to work so often due to my health.

I would like to begin a law suit if anyone else is interested.

I am definitely interested in a lawsuit against Slimband. I have lost thousands of dollars in pay due to having to take unpaid sick leave (in fact, I am lucky to even still be employed). Also, I'm told that almost everyone will need to eventually have to have it removed (mine hasn't been yet). My personal e-mail is jenannecoulter@yahoo.ca if you would like to connect with me.

I got my Slimband in November 2010 and have had issues with vomiting since day one. Almost 10 years later I'm starting to have almost unbearable symptoms (haven't been able to keep anything down since Friday, pain in my chest, difficulty breathing). I would love to hear from anyone that has had their Slimband removed and anyone that has sued them.

I have not personally sued but I want to. Unfortunately I am not sure how to go about it either. I did read this article which might be of interest. At some point I think almost all Slimband patients will have to have their bands removed. https://www.cbc.ca/news/health/gastric-band-surgery-marketplace-1.4479735 If you want to chat in person, add me on Facebook: https://www.facebook.com/jennifercoulter

I would contact your General Doctor and asked to be referred to a internal surgeon and have it removed. I had to have mine removed and it has caused me massive damage to my esophagus and upper stomach. I had issues with cancer in my esophagus three years ago and the surgeon felt definetly it had to due to the lapband and the negligence of the Dr. Lau's insertion of it. Please go and talk to your local MD asap so that you are treated for the pain and regurtiation immediately! Its very serious. There was a W5 series where two lapband patients suffered from this and both died because they left it too long.

I have spoken to the woman that won the Small Claims against Slimband but because they filed bankruptcy she hasn't been able to collect. I am thinking about filing against Dr. LAu personally but she also told be about a law firm in Vancouver that is doing a class action suit that are suing the company that makes the slim band. She has told me she will provide me with the law firm. As soon as I have info I will post info.

Thanks so much. I am very interesting in joining that class action. I think it's B.S. that they filed for bankruptcy because the doctor that owned the clinic also owned Credit Medical, that high interest loan company that fleeced many patients out of $15,000+ to have their surgeries (me included). They made TONS of money of that venture. I know that Credit Medical is still operating, so perhaps going after them is an option.

I doubt going after Dr. Patrick Yau would produce any results. It's the owner of the clinic that should be targeted.

Does anyone know, how long it takes for Medicare to approve surgery?

I think it depends entirely on what guidelines you're being referred under. I had that kind of insurance through the state as a low-income person for 10 years and even though I was over 400 lb for 10 years they denied me. All based on the fact that I did not have diabetes. I switched insurances once I was offered a different kind of coverage from work and was approved within two months

I got a little bag of samples when I saw the nutritionist last week. Turns out I much prefer the Celebrate 45 Tropical Twist vitamins to the Bariatric Fusion orange flavor, so I've placed an order for those and the sweet treat assortment of calcium soft chews, which were almost dangerously tasty. The Unjury chicken soup was better than the other brand I tried, but not enough to buy it. And their vanilla shake was vile. I just can't do artificial sweeteners, and probably not vanilla unless I add something to it to mask the flavor. The aftertaste was so strong and I had a vague impression of drinking baby formula. So far the only ones I've really liked have been the orange and peach flavored Syntrax Nectar Naturals, so I'm going to get two vegan fruit flavored options in case I have trouble with whey after.

PS: Also, the 'My Surgery' section of my profile - how do you edit/update that section??  I want to put my height, weight, etc. there but can't find edit button.
Can someone help me with that?
      Thanks in advance.

I'm new here and unsure how to reply/respond to people. Guess I'll figure it out, or maybe you can help me a lil. lol.  A lil direction would be nice.
I'm still wrapping my head around having this surgery to lose weight. I have completed all requirements, in 2022, and now it's a waiting game.  I missed a call in Aug. to have the surgery. 1st call I have missed in years and it had to be THAT one!   I was so upset at myself and then fell back back that weekend to my ol' comfort food; ice cream.  I fall from time to time but then get backup on my Johnny Wayne Saddle and do better.
I have been waiting so long I forgot what the specific surgery is called. 🤔.  It's the one where my stomach will look like a banana.  I just want this done so I can be on my way to a healthier and more active person, and hopefully feel physically and mentally better and better sleep too. We'll see.
Wishing everyone a safe and successful surgery.

Has anyone messaged you and helped?

If you go to the top of the page and click on your user name there will be a drop down that will allow you to do things from there. The interface on this site is a little wonky and could use some improvement, basically, you'll kinda have to click around until you find what you want to edit/update.

I tried adding stuff to my albums and it uploaded the same things twice and I can not delete the duplicated picture. If you add a ticker and later you want to update it, like you lost more weight or you're closer to a certain goal, you have to go through the whole ticker choosing process again. The site can be a little frustrating.

Today was my 1 month followup, 5 weeks post surgery. My dietician gave me a gold star review for my post op diet, and I graduated to Stage 4 of my program. Stage 5 should be approved in November, and that is the forever way of eating.
I had to go to a post op nutrition class as part of my appointment today. There was a young lady in there that had been eating WAY off diet, and she was not doing well... She had been eating fast food, but peeling the buns off, eating vegetables that were not well-cooked, and eating all kinds of foods that were not part of the detailed instruction that everyone in this program receives. We had SO many caveats from Day One to not try to jump ahead on the schedule for the foods that we eat. I was baffled that someone would decide to eat off program, especially so soon after surgery. She became tired of the liquids & soft foods, so she chose to eat ahead.
The result of her skipping ahead was that she had experienced a lot of vomiting & foamies, a lot of pain, and was unable to drink any fluids. She started feeling flushed and faint in class and had to be sent to the hospital to get some IV fluids.
The discipline that one needs for bariatric surgery cannot be overstated. We have to dig deep mentally and physically to get through surgery itself, learn new things, manage medications, and really lean into that crucial change of mindset and behavior. I hope that this young lady is able to get herself together to make the most of her surgery.

Great post. Thank you for the insight/update. So happy to hear you are doing so well. Keep up the good work.

I am still waiting for my surgery...though classes were completed 9/2022. I don't like the waiting game. But I will say that my 'surgery buddy' mentioned this site and am happy I'm hear and hope to gain support and insight for my surgery.
