Do I have the right to ask MD.....

Recommended Posts

So I read a post about googling your doc and reading reviews. All the reviews on my surgeon going back to 2003 are great and fit in with everything I have heard about him. According to his office, he has done over 5000 procedures and has had only 1 leak, an no other major complications. But what also came up is that he got a DUII in April. My question is do I have the right to ask him about this and if so how on earth do I bring it up? On a side note his DUII was received at 152 am on a Friday, and he is off that day. It is less concerning than had it been mid week, though I am so against drunk driving that it still irritates me.

I think it's up to you. My guess is he won't be thrilled with you bringing it up. But if it's a genuine concern of yours, you could try something like "I know you weren't on the job, but I was a little nervous when I read about your DUI."

My surgeon also had a great record, but was sued a couple years ago for refusing to operate on an HIV-positive patient. I was deeply troubled by that, as the risk would be nearly nothing as long as they are using proper surgical technique. A good friend of mine is HIV positive and he once accidentally cut himself cooking, and in helping him tend to his wound, I forgot about everything and ended up getting HIV-infected blood all over my skin. That was years ago, and I didn't get infected. Point being I saw it as a knock on my surgeon's ethics.

I weighed it, but ultimately decided that nobody's perfect, and went ahead with it. There's stuff in my past I'm not thrilled about...we all make poor choices sometimes.

But only you can decide if that's a deal-breaker. I imagine that if a good friend was killed by a drunk driver, I'd chose a different surgeon....I would feel too strongly.

This is tough. Only you can truly decide how you would like to proceed with this. It definitely would concern me, but he is human. He's not void of faults just because he's a Doctor. If he's getting great reviews by his patients then that should speak for itself. I mean if he cheats on his wife, is that any of your business? We all have personal lives outside of our professions and it seems his patients are happy with the end result. How many pilots have a few drinks before take off and we still get in that plane? Just my opinion. Good luck.

I would only ask him about it if you think his answer will have an impact on your decision to use him as your surgeon. In order to do that, you should visualize asking him the question, and imagine different answers that he might give. Personally I can only imagine his saying something along the lines of "Yes it was a terrible mistake. We had gone to a party and I usually don't drink, but I had a couple of drinks and ...."

I can't visualize a situation where he says "Well I usually get drunk every Friday night, and that night I got unlucky and got stopped. And I usually have a drink or two before the surgery just to steady my hands."

Since I can't imagine an answer other than the first one, I personally wouldn't ask him about it, but you should certainly ask if you want to.

Yep. It's gotta be your call...only you can decide how important the issue is.

Either you trust your surgeon or you don't . If you don't then I'd suggest you start looking for a new doctor.

What answer are you expecting to get from him that would make it OK for you to proceed? I suspect that nothing he would say would make you comfortable. If that is so, switch doctors now, unless you just want to punish him by putting him on the spot. I don't approve of drunk driving either, but personally I would never confront my doctor about it. That's just me, though.

      April Surgery
Am I the only struggling to get weight down. I started with weight of 297 and now im 280 but seem to not lose more weight. My nutrtionist told me not to worry about the pounds because I might still be losing inches. However, I do not really see much of a difference is this happen to any of you, if so any tips?
      Thanks

Well recovering from gallbladder removal was a lot like recovering from the modified duodenal switch surgery, twice in 4 months yay 🥳😭. I'm having to battle cravings for everything i shouldn't have, on top of trying to figure out what happens after i eat something. Sigh, let me fast forward a couple of months when everyday isn't a constant battle and i can function like a normal person again! 😞

Iʻm roughly 6 weeks post-op this morning and have begun to feel like a normal human, with a normal human body again. I started introducing solid foods and pill forms of medications/supplements a couple of weeks ago and it's really amazing to eat meals with my family again, despite the fact that my portions are so much smaller than theirs.
I live on the island of Oʻahu and spend a lot of time in the water- for exercise, for play,  and for spiritual & mental health. The day I had my month out appointment with my surgeon, I packed all my gear in my truck, anticipating his permission to get back in the ocean. The minute I walked out of that hospital I drove straight to the shore and got in that water. Hallelujah! My appointment was at 10 am. I didn't get home until after 5 pm.
I'm down 31 pounds since the day of surgery and 47 since my pre-op diet began, with that typical week long stall occurring at three weeks. I'm really starting to see some changes lately- some of my clothing is too big, some fits again. The most drastic changes I notice however are in my face. I've also noticed my endurance and flexibility increasing. I was really starting to be held up physically, and I'm so grateful that I'm seeing that turn around in such short order.
My general disposition lately is hopeful and motivated. The only thing that bugs me on a daily basis still is the way those supplements make my house smell. So stink! But I just bought a smell proof bag online that other people use to put their pot in. My house doesn't stink anymore.

Oh yeah, something I wanted to rant about, a billing dispute that cropped up 3 months ago.
Surgery was in August of 2023. A bill shows up for over $7,000 in January. WTF? I asks myself. I know that I jumped through all of the insurance hoops and verified this and triple checked that, as did the surgeon's office. All was set, and I paid all of the known costs before surgery.
A looong story short, is that an assistant surgeon that was in the process of accepting money from my insurance company touched me while I was under anesthesia. That is what the bill was for. But hey, guess what? Some federal legislation was enacted last year to help patients out when they cannot consent to being touched by someone out of their insurance network. These types of bills fall under something called, "surprise billing," and you don't have to put up with it.
      https://www.cms.gov/nosurprises
I had to make a lot of phone calls to both the surgeon's office and the insurance company and explain my rights and what the maximum out of pocket costs were that I could be liable for. Also had to remind them that it isn't my place to be taking care of all of this and that I was going to escalate things if they could not play nice with one another.
Quick ending is that I don't have to pay that $7,000+. Advocate, advocate, advocate for yourself no matter how long it takes and learn more about this law if you are ever hit with a surprise bill.
