Do Not Pay Dr. Kelly Deposit Until You Are Sure!

I am super frustrated right now, its been two weeks since I cancelled my surgery with Dr. Kelly and asked for my deposit back. I paid using the same bank that he uses so it was a quick transfer that took minutes, I asked for my money to be refunded the same way so it would be easiest and they told me they would work on it and would refund me. The only thing I have received from them to this day is headaches! Last Sunday, over a week after they said they would refund me, I emailed them and I have not yet received a reply! I know some other people had the same problem in the past when trying to get a refund from them (they posted here) but I should had listened!!!! Now I am having to go through my bank to get them to investigate it and refund my money. Thankfully I have the contract which says that I have 21 days to cancel before the surgery and would receive all my money back. Please, please, please if you are even 1% uncertain that you want to use Dr. Kelly do not pay your deposit! or pay it with a credit card! I was very sure when I booked it that I wanted him to be my surgeon but after much investigation I decided against it, and all they have done is show me how wise I was on my decision to change surgeons. I am so disappointed in the lack of professionalism that I have experienced with this surgeons staff.

Yes on May 7th and I cannot wait. What are they telling you about your deposit? That would make me very angry.

At first they tried to convince me not to change surgeons, then they finally agreed to refund me and said they would do it. Now they are not answering my messages!!! That makes me angry more than anything, they answered fast enough when I gave them my money but now they ignore me :/

I never sent a deposit at all. When I went a month ago, I took a certified check made out to Dr Kelly and paid Trish in cash. Have you tried calling Omar directly? I talked to Trish on Friday, you will love her.

When i contacted them they required for me to pay the deposit of $500 to schedule my appointment. I did talk to Omar last week when he sent me a message here pretending to me a patient (shaking my head)..... I am just so done with them. I have spoken to Trish numerous times and you are right she is awesome! I also spoke to Dr. Ponce and he is wonderful. He does not require a deposit so I will be bringing a cashiers check when I come for my surgery! I can't wait!

What do you mean pretending to be a patient? Do you have a direct number for Dr. Kelly? I would ask Trish what you should do and what they normally do about a refund. She should be able to tell you what the turn around time is for your money to be returned.

This is the # I have for Omar 619-395-5347. Is that the # you have been using? The truth of the matter is that the vsg is not a really complicated surgery. There are a lot of good doctors who will do a great job. The trick is to find someone you feel confident in and comfortable with because if you are totally stressed out, it will NOT be a good experience!

I agree. I am not sure the circumstances in which you changed doctors but Dr. Kelly I have heard is a great doctor. I just happend to get in touch with Dr. Garcia's team and went with them. I had a hard time getting in touch with anyone for Dr. Kelly because of all the crap going on so my gut told me to choose Dr. Garcia. You have to be confident with the doctor you choose because ultimately that is the one you will be trusting to remove your stomach.

I am sure you all have seen post by someone called Tmom? Well that is Omar, he emailed me after I posted my opinion about the FACS. Fortunately I already knew it was him because some people had mentioned it to me. After I replied and told him I knew who he was, he stopped bothering me lol..... I am not sure if that was the number or not DDFinn, they know I want my deposit back and I have been super nice to them but now I am just fed up with their unprofessionalism. I will just let my bank take it from here I just want my surgery with Dr. Ponce to be here already, to get my money back and not have to talk to Dr. Kelly and his staff anymore. If worse comes to worse I will just contact the FACS and file an official complaint, I have tons of emails and voice recordings to cohaborate an unprofessionalism complaint.

What is FACS? Sorry I am out of the loop I guess. You do whatever you have to do this is unprofessional and I do not blame you one bit. I am sure everyone will back you up on this.

      Oh yeah, something I wanted to rant about, a billing dispute that cropped up 3 months ago.
      Surgery was in August of 2023. A bill shows up for over $7,000 in January. WTF? I asks myself. I know that I jumped through all of the insurance hoops and verified this and triple checked that, as did the surgeon's office. All was set, and I paid all of the known costs before surgery.
      A looong story short, is that an assistant surgeon that was in the process of accepting money from my insurance company touched me while I was under anesthesia. That is what the bill was for. But hey, guess what? Some federal legislation was enacted last year to help patients out when they cannot consent to being touched by someone out of their insurance network. These types of bills fall under something called, "surprise billing," and you don't have to put up with it.

      I had to make a lot of phone calls to both the surgeon's office and the insurance company and explain my rights and what the maximum out of pocket costs were that I could be liable for. Also had to remind them that it isn't my place to be taking care of all of this and that I was going to escalate things if they could not play nice with one another.
      Quick ending is that I don't have to pay that $7,000+. Advocate, advocate, advocate for yourself no matter how long it takes and learn more about this law if you are ever hit with a surprise bill.

      Thank you everyone for your well wishes! I totally forgot I wrote an update here... I'm one week post op today. I gained 15 lbs in water weight overnight because they had to give me tons of fluids to bring my BP up after surgery! I stayed one night in the hospital. Everything has been fine except I seem to have picked up a bug while I was there and I've been running a low grade fever, coughing, and a sore throat. So I've been hydrating well and sleeping a ton. So far the Covid tests are negative.
      I haven't been able to advance my diet past purees. Everything I eat other than tofu makes me choke and feels like trying to swallow rocks. They warned me it would get worse before it gets better, so lets hope this is all normal. I have my follow up on Monday so we'll see. Living on shakes and soup again is not fun. I had enough of them the first time!! LOL

      Still purging all of the larger clothing. This morning, a shirt that I ADORED wearing ended up on top. Hard to let it go, but it was also hard to let go of those habits that also no longer serve my highest good. Onward and upward!
