So I'm nearly halfway through by insurance requirements for surgery. In month 3 of 6, labs done, gallbladder sonogram done, upper GI scope done. I started looking at what I need to do to get a leave of absence approved at work and I completely forgot that because I'm at a new job that I don't qualify for FMLA until the end of August. Its only an extra 2 months but it seems like when you decide you want to go through with the surgery that waiting that 6 months is long enough. Trying to look for silver linings - I'll have accrued that much more sick time and vacation time to pay for the several weeks off.... okay that's all I can think of....

*Sigh* Just bummed a little and venting.

All FMLA says is that they can't fire you while you're out, and companies can find a way around that anyway.

Are you sure you're not talking about being eligible for paid time off?

FMLA - Family and Medical Leave Act covers unpaid time off for an individual's medical condition or medical needs of a family member. If your company has at least 50 more employees and you have worked for them 12 months or 1250 hours, you would be eligible for up to 12 weeks of unpaid leave during which they must hold your job open.

PTO - paid time off -or sick leave, may be something your employer offers which would give you paid time off while you are ill. It could be a combination of vacation and/or sick leave. You probably want to talk to HR to find out what you would be eligible for.

I'm a desk jockey and I took less than a week off. Most desk jobs folks take about 2 weeks off.

I'm getting 3 weeks off. I could have technically had 6 weeks off, but hate being away from work for so long. I work at a desk too... but I wanted time for myself and to get into a routine. My company has short term disability, I get 100% of my pay during those 3 weeks. Maybe look into that?

Well I contacted HR and they said that I could qualify for nonFMLA leave of absence if the surgery is NOT elective. But I’m guess they consider it elective. The surgery coordinator says they can’t change the classification of the surgery it’s up to the employer’s policies. [emoji853]

Your Dr is the one who determines if it's medically necessary or not. Obesity is a clinical definition, and if your Dr declares you obese, that should be it. Waiting periods might come into play, but HR shouldn't be making a judgment call as to necessity. I called our provider, gave the facts, and a determination was made. I needed less than 1, but took 4 and wish I took 6. I haven't had that much time off since I was 16 years old. It was marvelous! I

Do you even need medical leave? Do you have enough PTO that you can just take the time without justifying it to HR? As others said a week is really all you need.

If you have a co-morbidity, then it can be classified as a medical necessity. I'm lucky that my boss is a Cardiologist and he's writing a letter on my behalf, as well as the surgeon as to the medical necessity (using Cardiomyopathy to prevent any future cardiac events) to get me FMLA and Advanced PTO (where they pay me, and as I acquire PTO I just pay it back). Maybe you can get your PCM to write a letter as to how it's a medical necessity and not elective. Good luck!

I don’t have any comorbidities, I qualify only because my BMI was over 40. Because I’m a nurse I will need 3-4 weeks off so I can’t simply take vacation time for it. It only ends up being about 6 weeks later than I originally had planned so it’s not a big deal.

      Iʻm roughly 6 weeks post-op this morning and have begun to feel like a normal human, with a normal human body again. I started introducing solid foods and pill forms of medications/supplements a couple of weeks ago and it's really amazing to eat meals with my family again, despite the fact that my portions are so much smaller than theirs. 
      I live on the island of Oʻahu and spend a lot of time in the water- for exercise, for play,  and for spiritual & mental health. The day I had my month out appointment with my surgeon, I packed all my gear in my truck, anticipating his permission to get back in the ocean. The minute I walked out of that hospital I drove straight to the shore and got in that water. Hallelujah! My appointment was at 10 am. I didn't get home until after 5 pm. 
      I'm down 31 pounds since the day of surgery and 47 since my pre-op diet began, with that typical week long stall occurring at three weeks. I'm really starting to see some changes lately- some of my clothing is too big, some fits again. The most drastic changes I notice however are in my face. I've also noticed my endurance and flexibility increasing. I was really starting to be held up physically, and I'm so grateful that I'm seeing that turn around in such short order. 
      My general disposition lately is hopeful and motivated. The only thing that bugs me on a daily basis still is the way those supplements make my house smell. So stink! But I just bought a smell proof bag online that other people use to put their pot in. My house doesn't stink anymore.

      Oh yeah, something I wanted to rant about, a billing dispute that cropped up 3 months ago.
      Surgery was in August of 2023. A bill shows up for over $7,000 in January. WTF? I asks myself. I know that I jumped through all of the insurance hoops and verified this and triple checked that, as did the surgeon's office. All was set, and I paid all of the known costs before surgery.
      A looong story short, is that an assistant surgeon that was in the process of accepting money from my insurance company touched me while I was under anesthesia. That is what the bill was for. But hey, guess what? Some federal legislation was enacted last year to help patients out when they cannot consent to being touched by someone out of their insurance network. These types of bills fall under something called, "surprise billing," and you don't have to put up with it.

      I had to make a lot of phone calls to both the surgeon's office and the insurance company and explain my rights and what the maximum out of pocket costs were that I could be liable for. Also had to remind them that it isn't my place to be taking care of all of this and that I was going to escalate things if they could not play nice with one another.
      Quick ending is that I don't have to pay that $7,000+. Advocate, advocate, advocate for yourself no matter how long it takes and learn more about this law if you are ever hit with a surprise bill.

      Thank you everyone for your well wishes! I totally forgot I wrote an update here... I'm one week post op today. I gained 15 lbs in water weight overnight because they had to give me tons of fluids to bring my BP up after surgery! I stayed one night in the hospital. Everything has been fine except I seem to have picked up a bug while I was there and I've been running a low grade fever, coughing, and a sore throat. So I've been hydrating well and sleeping a ton. So far the Covid tests are negative.
      I haven't been able to advance my diet past purees. Everything I eat other than tofu makes me choke and feels like trying to swallow rocks. They warned me it would get worse before it gets better, so lets hope this is all normal. I have my follow up on Monday so we'll see. Living on shakes and soup again is not fun. I had enough of them the first time!! LOL
