Obama’s birth...where really??

Pennsylvania's former deputy attorney general and Sen. Hillary Rodham Clinton supporter Philip J. Berg has filed a lawsuit in federal court in Pennsylvania accusing presumptive Democratic presidential candidate Sen. Barack Obama of lying about his U.S. citizenship, which would make him ineligible to be president.

Mr. Berg is one of a faction of Clinton supporters who haven't heeded the party's call for unity, filing the suit just days before the opening of the Democratic National Convention, which will nominate Mr. Obama as the party's presidential candidate.

The suit, filed in U.S. District Court in Philadelphia last week, also names the Democratic National Committee and the Federal Election Commission and says Mr. Obama..s mother went to Kenya late in her pregnancy and ended up giving birth there. It also claims that later in life, Mr. Obama declared himself a citizen of Indonesia.

Well, I just read that yesterday Berg filed a motion for a summary judgment in this case, because Obama didn't produce the documents by the deadline. According to Berg, constitutionally that means that he has admitted the allegations. Also, this apparently isn't just an issue of whether he was born in the US, but also if he forfeited his US citizenship when he lived in Indonesia. He also supposedly traveled to Pakistan in 1981 when it was a no-travel zone for Americans (and they weren't letting American citizens in) and he traveled under an Indonesian passport instead.

As an interested observer of Constitutional Law, this is absolutely fascinating to me. Again, I doubt anything will come of it, but I'm really curious about the twists and turns the cases are taking.

The suit has also been filed against the DNC as well. The guy doing this is a Hillary supporter, so I wonder if he thinks if Obama is disqualified, the DNC would automatically move Hillary into his spot?

I saw a similar e-mail before the Democratic Convention and thought it looked "interesting" until I Snoped it out. But snopes aside it just doesn't make sense that there could be any merit behind this rumor or Hilary would have been all over it long before now.

I agree....it is totally weird that it hasn't been totally quashed by appropriate legal action.

That it hasn't been answered in the proper legal framework adds to the oddness.

Lawsuits in Washington and Georgia are seeking state superior courts to force the states’ secretary of state, as the chief state elections officer, to require Obama to produce original birth records from Hawaii, or else decertify him as a candidate for the presidency.

I have to add one thing: I really hope Obama can defeat all of these charges, because the thought of the rioting in the streets that will occur should he be disqualified gives me a knot in my stomach.

Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.

This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?

So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.

According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

Personally, if Obama was from Mars I would still vote from him because the alternative is voting for more of Bush. But, no, he is not from Mars, he is from Hawaii.

McCain voted to support Bush's decision 90% of the time. So, if you think we are doing great as a nation, vote for McCain and Palin and get more of the same or worse. But dont come whine about no money, no house, no healthcare, no job, no schools, and your kids being forced into the army to go fight pointless and costly wars.

What is shocking is how low the McCain campaign is willing to go in the hopes of swaying votes their ways. First Obama is not American, next he hangs with terrorists, third he is a marxist. It is pathetic and embarrassing and explains why records numbers of true republicans are voting for a democrat for the first time in their lives.

I hope for the republicans that out of the rank someone will emerge that truly represents the party's values as they once were. Right now it is the party of Karl Rove and it will lead to a social democracy and further erosion of the constitution and the rights of our citizens.

Under Mr. Bush and Vice President Dick Cheney, the Constitution, the Bill of Rights, the justice system and the separation of powers have come under relentless attack. Mr. Bush chose to exploit the tragedy of Sept. 11, 2001, the moment in which he looked like the president of a unified nation, to try to place himself above the law.

Mr. Bush has arrogated the power to imprison men without charges and browbeat Congress into granting an unfettered authority to spy on Americans. He has created untold numbers of “black” programs, including secret prisons and outsourced torture.

The president has issued hundreds, if not thousands, of secret orders. We fear it will take years of forensic research to discover how many basic rights have been violated.

Both candidates have renounced torture and are committed to closing the prison camp in Guantánamo Bay, Cuba.

But Mr. Obama has gone beyond that, promising to identify and correct Mr. Bush’s attacks on the democratic system. Mr. McCain has been silent on the subject.

Mr. McCain improved protections for detainees. But then he helped the White House push through the appalling Military Commissions Act of 2006, which denied detainees the right to a hearing in a real court and put Washington in conflict with the Geneva Conventions, greatly increasing the risk to American troops.

Basically our enemies are winning. The current administration has plunged America into economic and constitutional turmoil and used our stupidity as a people in keeping Bush on his throne to destabilize our country and turn it further and further away from the constitution.

This would be a pretty hot story....if it were true. As it is, the MSM seems to have no interest in examining the evidence, they've already made up their minds.

Nice try, but the guy who brought this suit is a lifelong Democrat who has held political office as a Democrat.

Speaking for myself only (as I can't speak for others on this board but I hope they will chime in and agree), if the same concerns were raised about McCain -- and he refused to refute the evidence and/or phonied evidence up -- I would be equally concerned about the potential Constitutional crisis that might ensue.
