So around the july 25th?ish I made a point to talk to my boss and give her a heads up since I had just met with my surgeon. Being I work in a hospital on a very busy floor I have been wanting to give as much notice as possible so we can find a stand in for my shifts. Well my next appointment is set for sept 1st but the insurance company called this past Tuesday saying I had been approved, which was weeks faster then we had planned. Also the dr told me I had to lose 15 lbs, and so far I've dropped 12. So I will be calling my surgeon to get an appointment in the next few days to move this along quicker. So this is all moving much faster then I had planned. I tried to explain that to my boss and instead of looking at a 3rd week n sept date I looking at a last week of Aug date. Our schedule are put out for 28 days at a time which means I will still work all but 1 week of this next schedule. Anyway it didn't go over very well and she got about half way through the statement of "well I can't guarantee your job". I'm more then a little worried about losing said job but I have no protection under fmla since I've only been with my hospital 7 months. But it more then a little irritates mr becuase when i first told her about this she aaid she would do whatever we needed because this was important. At the same time I don't think I can put this off again, this is the second time I've had to do all this I'm ready to be on the other side of it. Ugh just really frustrated... I don't want to lose my job but I can't wait another month I've been on a modified liquid diet for 2 weeks already

40 hours times 4 weeks is 160 hours total. Not sure if you don't work a full 40 hour week. But when I go to have my surgery I need to have 160 hours saved!

We work 3 12 hr shifts a week that's only 72 hrs per pay period which puts it at 144 for 4 weeks

I've never worked in the field, but, given the nature of a hospital, it seems that there will be no "better time" for the hospital or for her.

You are absolutely right! There's never a time when you are fully staffed and it's convenient for someone to take time off!

Having worked in hospitals, the only "better time" will be after she's been there a year and has FMLA protection. In relation to staffing and the manager putting herself in a bind, it will never get better.

She can say elective, but honestly , your doing a life change, and no one, boss, family whoever, should stop you. This is for YOU. You deserve this to make your life better. Don't let negative people get in your way. Congrats on getting there quickly! Blessing to you!

Is this really elective surgery? I have a diagnosis of "morbid obesity." That doesn't sound like anything is elective. Does your insurance consider it elective?

For most the medical necessity is the benefits and success outweighs risk or chronic condition being unaddressed. It is elective in that you have other options to "cure" morbid obesity this is one that can be covered by insurance like some of the obesity meds.

I am a regional HR Manager, obesity is covered under ADA, you don't have to have the 1250 hours or be working for a year to be able to take a leave for an ADA related illness/procedure. She really doesn't want to mess with ADA. Go there tell her you want to take time off for the ADA related illness, she will be forced to enter into what is called an interactive process with you and your time off will be granted.

Totally unrelated to BWLS, Andreaj, but do you know how FMLA comes down on pregnancy with relation to the 1250 hours/working for a year? My husband is a department chair (at a college) and is caught in the middle between one of his faculty and his associate dean. He's been trying to get a clear answer but of course the people who understand these regulations are the ones trying to deny coverage to his faculty member. All he needs is a clear explanation, but is having trouble getting such!

Fmla is the same no matter what in terms of the eligibility qualifiers; however there is a Pregancy discrimination act that makes some pregnancy related conditions fall under the ADAA, qualifying for this entitles pregnant women some consideration as well if not eligible for FMLA

Well as of yet I have been give off from the 21st of Aug (the day before surgery ) through the 19th of sept. And all of my shifts have been covered. Now just to see how things go when I go back
