Now that Dr. Garcia himself is looking into it I hope we can let this go.

I also hope, regardless of the outcome and regardless which version is true, that Blindsided speak with a counselor to help her cope with what has obviously been an overwhelmingly emotional experience.

The law of defamation protects a person's reputation and good name against communications that are false and derogatory. Defamation consists of two torts: libel and slander. Libel consists of any defamation that can be seen' date=' most typically in writing. Slander consists of an oral defamatory communications. The elements of libel and slander are nearly identical to one another.

Specific requirements that a plaintiff must prove in order to recover in a defamation action differ from jurisdiction to jurisdiction. Under the Restatement (Second) of Torts, which is drafted by the American Law Institute and has been influential among state courts, a plaintiff must prove four elements.

First, the plaintiff must prove that the defendant made a false and defamatory statement concerning the plaintiff.

Second, the plaintiff must prove that the defendant made an unprivileged publication to a third party.

Third, the plaintiff must prove that the publisher acted at least negligently in publishing the communication.

Fourth, in some cases, the plaintiff must prove special damages.

With this being said BS has placed herself and others in a very difficult spot. SHE (either willingly or thru coercion) has OPENLY stated that SHE lied. Basically admitting libel!! If in fact what she said was 100% truth, the way that she went about expressing the truth makes her actions questionable, especially when she turned around and recanted her story. People have taken what she has said and made the assumptions that the man could be capable of "rape and molestation of a pt while under anesthesia."

If indeed he is guilty of sleeping with patients, in the United States he may be deemed guilty of moral turpitude; however, if what the OP has accused him of is untrue, in the United States he would be entitled to punitive damages (which wouldn't be difficult to recover since she's admitted she "lied".

Oh my, the drama never ends here. I suggest that you all let sleeping dogs lie and "back away from the fire".

Truth or untruth, in the end we ALL must answer to a higher power who is ALL knowing. So if it seems as though he's "getting away" with things, he won't be. And if the OP is indeed "lying" then SHE will have to be held accountable on THAT day.[/quote']

This is the way I was looking at it. From a legal point of view. And the possible business loss from these allegations. If I ever get tired of trying to lose my last 5lbs to get the ball rolling for surgery here in the states I wouldn't hesitate in considering Dr. Garcia. I've dealt with all kind of men and know how to handle them.

Notice the lack of men commenting on this story. While many women are drawn to drama (Even Me) most men stay clear.

And let me say that Dr Garcia and his team are great at performing weight loss surgeries. when we choose a surgeon for such an invasive procedure, what's important is his surgical competency. I would recommend him without hesitation. If you choose to use him you will be in good hands.

I stand by the doctor in this and will continue to recommend this team. I don't need to be involved in the bullshit on this forum to know that I believe in these doctors - I will rely on my personal knowledge of this team of wonderful, caring professionals.

That is disgusting. A man's life is ruined because someone didnt know the meaning of a one night stand. I understand it was unprofessional of him but I guarentee it if they were still "together" there wouldn't be an issue. Or if she knew someone who she just met overseas doesn't want a relationship.

I will say one more thing here.. Calling out someone who you "think" it is, is wrong. And for everyone that wants to attack the op?

You are not helping Dr. Garcia in the least bit..

He did what he FELT was right.

And does not need needless attacks against the "perceived" person who this happened to.

Question for anyone, how did you get your mind right before surgery? Like as far as eating better foods and just doing better in general? I'm having a really hard time with this. Any help is appreciated 🙏❤️

I had about 6 months between deciding to do surgery and getting scheduled. I came across the book The Pound of Cure by Dr. Matthew Weiner, a bariatric surgeon in Arizona, and started to implement some of the changes he recommended (and lost 13 lbs in the process without ever feeling deprived). The book is very simple, and the focus is on whole, plant based foods, but within reason. It's not an all or nothing approach, or going vegan or something, but focuses on improvement and aiming for getting it right 80-90% of the time. His suggestions are divided into 12 sections that you can tackle over time, perhaps one per month for a year if a person is just trying to improve nutrition and build good habits. They range from things like cutting out artificial sweetener or eating more beans to eating a pound of vegetables per day. I found it really effective pre-surgery and it's an eating style I will be working to get back to as I am further out from surgery and have more capacity. Small changes you can sustain will do the most for building good habits for life.

That sounds awesome. I'll have to check that out thanks!

I've hit a stall 9 months out. I'm not worried, though. My fitness levels continue to improve and I have nearly accomplished my pre-surgery goal of learning to scuba dive! One dive left to complete to get my PADI card 🐠
I was able to go for a 10K/6mile hike in the mountains two days ago just for the fun of it. In the before days, I might have attempted this, but it would have taken me 7 or 8 hours to complete and I would have been exhausted and in pain for the next two days. Taking my time with breaks for snacks and water, I was finished with my wee jaunt in only 4 hours 😎 and really got to enjoy photographing some insects, fungi, and turtles.
Just for fun last week, I ran two 5Ks in two days, something I would have never done in the past! Next goal is a 10K before the end of this month.

Hi everyone, I wrote back in May about having no strength. I still get totally exhausted just walking from room to room, it’s so bad I’m using a walker with wheels of all things. I had the gastric sleeve Jan. 24th. I’m doing exactly what the programs says, except protein shakes. I have different meats and protein bars daily, including vitamins daily. I do drink my fluids as well.  I go in for IV hydration 4 days a week and feel ok just til evening.  So far as of Jan 1st I’ve dropped 76 lbs. I just want to enjoy the weight lose. Any suggestions or has anyone else gone thru this??  Doctor says just increase calorie intake, still the same.

Losing my hair in clumps and still dealing with "stomach" issues from gallbladder removal surgery. On the positive side I'm doing better about meeting protein and water goals and taking my vitamins, so yay? 🤷‍♀️
