Can I Use Fmla/disability

I filed FMLA and used my Short Term Disability coverage and stayed off the full 6 weeks. I am 5 1/2 months out and have not missed one sick day since returning to work. Loving it!! Yes, use it and if you have Short Term Disability coverage with your employer use it too as that is one of the benefits your company offers you! :)

FMLA only protects your position at a company so long as you do not exceed 12 consecutive weeks in a 12 month period. Even then your specific position is to guaranteed. Only a comparable position within the organization is guaranteed.

. I had an employee that used FMLA, exceeded her 12 weeks and was let go when she came back to work. She almost died several times due to stage 4 breast cancer.

Best advice.....read up on the policies.

THANKS EVERYONE FOR THE INFO...I am sure when I do go to submit they will find out its for weightloss surgery because I assume the Bartric doctor would have to submit paperwork for me to be off. Wish me luck I just started the process of finally going to see a dr about the surgery.

Not necessarily....my surgeon just called it abdominal surgery on the paperwork he filled out for fmla.

Is there anybody that has gotten approved for STD? I am checking into it now. Sound like 3 weeks in common. My job sucks really bad and need a mental break as well. I have been getting pissed off for no reason other than the fact I am at work. Is there a form doctor can put 6 weeks on? I also found out the STD provider (Liberty Mutual) pays the employer and the employer will take out taxes and health insurnance out and provide a normal pay check. Liberty mutual said they can't open a claim until within 14 days prior nor 7days after start of disability off work date. The rate of pay varies by plan. Mine is based on years of service and at where I am it pays 100% for 3 weeks and 60% for additional weeks upto 25 total weeks.

It is up between you and your Dr. I requested 3 weeks. I did read where people took 6 weeks. Talk to your Dr. explain you feel 6 weeks would be best for you. My Dr. did not even question when I asked for an extra week.

Update. I got scheduled for Oct. 8th. Doctor said no to more than 3 weeks. Filed with Liberty Mutual for STD 9/24. They called today and said they would process the claim but not to expect approval as it is elective and not immediatly medically necessary.

Did anyone's claim get denied? I don't know yet but it doesn't sound promising.

You should have no problem being approved for your STD.. By having surgery you are eligible because your surgery is medically necessary because of obesity.. You shouldn't worry..

I havent gotten approved yet for surgery so I hope that they will allow it...Good luck I hope you get approve

My company/STD will pay me %100 up to 8 weeks, but my surgeon only allows patients 1 week off. Not real happy about that b/c I have a very labor intensive job outdoors. I

Afraid I'm gonna get real fatigued or dehydrated when I first go back. Oh well, I'll just have to deal with it!!

@ careless... can u find a new surgeon? That seems extremely rediculous.... ur having abdominal surgery! My dr has different requirements depending on ur job but as a nurse, he wanted me off 6 wks... i ended up back after about 5, but there's no way in hell i couldve went back after 1!

Well my surgery date is set and I've already paid for it so I doubt it. I really like the guy, just not that specific policy of his. I didn't know if maybe I could go to my PCP and have him fill out the forms for me to be off longer. I have to turn in a form to my HR every 30 days I'm off.

      I've hit a stall 9 months out. I'm not worried, though. My fitness levels continue to improve and I have nearly accomplished my pre-surgery goal of learning to scuba dive! One dive left to complete to get my PADI card 🐠
      I was able to go for a 10K/6mile hike in the mountains two days ago just for the fun of it. In the before days, I might have attempted this, but it would have taken me 7 or 8 hours to complete and I would have been exhausted and in pain for the next two days. Taking my time with breaks for snacks and water, I was finished with my wee jaunt in only 4 hours 😎 and really got to enjoy photographing some insects, fungi, and turtles.
