Time off work for surgery

I only put in for a week off at work but it will be without pay because I don't have enough vacation time saved up..I thought with FMLA you had to be out of work for 6 weeks or more to apply? Cause if that's the case that I could possibly get paid for it or if I need more time' date=' I may have to look into this..Does this apply in NY as well do you know? thanks.[/quote']

I'm taking a month off per my surgeon's advice. I went through FMLA. Does anybody know if short term disability automatically kicks in with an FMLA leave or is it something you have to submit separately?

I have a labor job. I had a week off vacation, one week off unpaid, 2 weeks light duty and just went to my surgeon for my 4 week check up and he said I still can't lift more than 25lbs so he told me I had to be on light duty for another 2 weeks. ugh I'm waiting for a phone call from work to see if they will approve me for 2 more weeks of light duty, if not I'm screwed and won't be able to work for the next to weeks. If that is the case I will be looking into my short term disability, it doesn't pay much but at least it's something.

I think it depends on where you work and how/if they offer it. I have to go through the office that deals with my pension to get my short term disability.

FMLA is a federal law. You have to know you will be out for more than three days. You are allowed up to 12 weeks per year (or the equivalent in hours). Just because you are allowed that doesn't mean you get to take it. You get what your physician recommends. It can be adjusted later if necessary. Short term disability is different for each employer depending on the plan that is selected. Your benefits group should be able to tell you or call the company directly. You will have to apply for it as it is not automatic.

It's important to note that family medical leave is UNPAID leave, unless the employee uses vacation/sick leave during the absence.

I have a desk job. I was sleeved on Wednesday march 13. Used 3 sick days for that day and 2 after and went back to work on Monday march 18th and worked 12 hours that day. Am a little tired but really was no problem going back. Keeps mind off food although no hunger so have to remember to think about it or will feel faint. Eat by the clock. Or drink since no solids for 1 more week for me.

I took off 6 week fmla and short term disabilities as well I went back in 5weeks I wanted to have my eating and food plans down pack ..

I'm from NY. I was sleeved march 4. I took fmla and short term disability as my dr wants me off for at least 3 weeks due to my job requirements. My job takes all available vac, sick, and holiday time before fmla and short term dis kick in.

I'm pretty sure that might actually be illegal for your company to do. My company did that for about 6 months a few years back and had to stop because vacation and personal leave days are earned and are yours to take when you want not when they say you have too. If this is an issue for you, you might want to look into it.

It's not illegal. In my organization you are required to use all PTO balances prior to utilizing STD.......and I work for the government.

Well that sucks. :( My company is huge and tries to get away with everything they can to save a buck and make us work more. I'm sooo glad they were forced to get rid of that policy. Maybe my union had something to do with it. I just know that if I had FMLA to take care of a family member that was sick, I would hate to have to take a vacation day every time I needed to take them to a doctors appointment. What would be the point in even getting FMLA unless you were going to be out of work for over 6 weeks.

It's really for job protection and not money. My son was in and out of the hospital over five months. I got intermittent FMLA that allowed me to take time as needed and they could not use it against in terms of performance etc

I work for a large company and had surgery once before. The first week is sick pay then anytime after that is short term disability with full pay. The amount of pay depended on how long I had worked there, different percentage at 1yr, 3yr, and over 5 yrs. we have a separate company that handles all leave requests so your info remains private and your employer/coworkers don't get any details about what you're having done. They handle making sure youre approved for the time off so you're not fired for attendance reasons. My HR department had no idea how I would get paid, I had to call our Group Time Reporter, they handle any pay code issues for each region of the country. It was a lot of work to figure everything out, but its worth it to make sure you get paid correctly.

Now I'm just worried about how much time to take off. I work 10 hour shifts standing all day and I don't want to push myself too much. But I also get stir crazy sitting at home and not being productive. What to do, what to do? :)

      I've hit a stall 9 months out. I'm not worried, though. My fitness levels continue to improve and I have nearly accomplished my pre-surgery goal of learning to scuba dive! One dive left to complete to get my PADI card 🐠
      I was able to go for a 10K/6mile hike in the mountains two days ago just for the fun of it. In the before days, I might have attempted this, but it would have taken me 7 or 8 hours to complete and I would have been exhausted and in pain for the next two days. Taking my time with breaks for snacks and water, I was finished with my wee jaunt in only 4 hours 😎 and really got to enjoy photographing some insects, fungi, and turtles.
