My surgeons office sent out email with all patients names CC'd. How upset would you be?

I did call the office. I started with the program director who sent out the email yesterday. She admitted it was a mistake and she simply forgot to Bcc and instead just Cc'd everyone in the program. She apologized but the damage has been done. After that I spoke with the office manager who apologized as well. I do know one person on the list (the mother of a friend of mine) and Im hoping she ignored the email and didn't take the time to read the hundreds of names on the list. Im still pretty upset. If an office can't be trusted with following simple HIPPAA policies how good are they at taking care of me? I've gone through all the hurdles and my surgery is just three weeks away. I don't want to start over yet Im having trouble mentally wrapping my brain around hundreds of people knowing I've had the surgery and having my contact info. I need to get past this and get back in the right frame of mind but Im still pissed and hurt.

Your HIPAA rights were violated.

And other privacy rights of yours were also violated by this egregious email mishandling.

In your situation I'd consult an attorney.

You have done the best thing you can to address the issue.

Please don't let this derail your efforts and focus.

You just have to trust that what is supposed to happen will happen.

I doubt seriously anyone will be combing through such a long list.

I understand your anger and disappointment that your email address was shared but you really need to decide how much energy you want to devote to worrying that someone will see it.

I wonder if anyone will be reprimanded? (Is that the correct word? "Get in trouble")

I entirely agree with everyone else on this thread - I would be totally livid if this happened to me, but we do have to accept that people do make mistakes (even if they are huge) and that you made the decision to have surgery for a reason don't allow someone else's mistake to damage the future you are choosing for yourself.

Ultimately once you have had surgery and are feeling more confident and comfortable you may choose to share your decision with a few more people, that's your choice, I'm just speaking from experience now as I made similar choices around sharing information with others pre-op but have now chosen to speak to five or six close friends regarding my decision and reasons and I am lucky everyone is 100% supportive and encouraging.

Concentrate on why you have chosen to do this and what you want to achieve, confidentiality breaches are wrong but it can't be taken back and you have so much more to lose (possibly in more ways than one) to allow this to affect your entire future, if people do find out and ask you about it, be brave and tell the truth, say it was a mistake or anything you like - it's nobody else's business just do what's best for you.

I would be mad, too. Unfortunately, being mad does not un-ring that bell. You've let them know how you feel, and you could consult an attorney. Maybe they would have to pay a fine.

For me, it would come down to how much effort I wanted to spend making them pay, vs how much I wanted to continue to go there. I also am private and didn't tell many people. However, 3 years later it's much less of a big deal to me. My docs office put my before and after picture in their waiting room book, and someone who went there for another type of surgery mentioned it to me! It even had my before weight in it, along with health conditions. I'm pretty sure I didn't sign the consent for that. I just decided to let it go. I like them, they have been really good to me, and now I feel like maybe I could help someone. The law is the law, and it's on your side here, but it really comes down to what matters most to YOU.

As a worker in the health care field I can tell you that is a definite HIPPA violation and you need to put a stop to that practice of emailing ASAP.

This is against the law and obviously someone made a mistake. As a doctor in healthcare administration, this is a clear violation of your medical privacy. Contact the provider immediately.

I’d be furious, and I’m really sorry this happened to you. I agree – it sounds like a HIPAA violation:

““Individually identifiable health information” is information, including demographic data, that relates to:

  • the individual’s past, present or future physical or mental health or condition,
  • the provision of health care to the individual, or
  • the past, present, or future payment for the provision of health care to the individual,

and that identifies the individual or for which there is a reasonable basis to believe it can be used to identify the individual.”

I would definitely contact the office and find out what happened – whether it was an innocent mistake, possibly by a new employee, or if that’s the office’s standard practice. You could also ask what they intend to do to fix the problem and possibly compensate you in some way.

If you want, you could pursue it. I think you can file a complaint through HHS. http://www.hhs.gov/ocr/privacy/hipaa/complaints/index.html

Again, I’m really sorry this happened to you. On the positive side, those 500 plus email recipients who now know your personal information are probably very sympathetic to your situation.

Wow. OP's issue is definitely not ok, but this is in another league entirely.

You can take the email and file a HIPAA violation. I can help you do that if you want to PM me.

I would also advertise who the doctor was. I'm putting together things because I want others to be safe, and to show them just how these "medical boards" and the like act and better ways of getting justice for hurt patients.

This does appear to be a HIPPA violation. You did exactly the right thing by reporting it to your doctor's office so they can correct their mistake and keep from making more. Good luck with your upcoming surgery. Just for the record, I had my sleeve 3 yrs ago, I paid a lot more of a deductible to try to keep my fellow meddling RN friends at the hospital where I worked out of my business and 10 days after surgery was 911'd to the hospital where I worked!! Cat sure got out of the bag quickly, but not like thought it would. These friends I'd tried to keep in the dark changed and saved my life..I'm not trying to minimize your situation, just share with you how life has a way of doing what it pleases.

      Four days post surgery. I am sipping as fast as I can and getting NO WHERE near the goal of 60 - 80 grams of protein or the 64 oz of liquids. I just feel FULL. I don't know if it can still be the gas build up (I would think by now that would be gone) but it is a struggle to drink. And so far I have not had the nausea or spasms and don't want to wander into that territory by pushing too hard with liquids. I about passed out today as it was my most "strenuous" day. Went from second story to basement for shower and I was sure I was going to pass out. Looking back on my last few days I have had a total of less than 1000 calories. Am I just not getting enough nourishment in me? Once again a friday where I can't get ahold of the doc until Monday rolls back around so I am hoping maybe someone here has some experience on how to keep energy going. I do have fibromyalgia too and that may be where some added fatigue comes into play. How did you all fair with the goals the week after surgery?

      2 days until I fly out to San Diego to have my Bypass Surg. in Tiajuana Mexico. Not gonna lie, the nerves are starting to surface. I don't fear the surgery itself, or the fact that I'm traveling alone, but its the aftermath that I'm stressing about the most, after this 8 week wait. I'm excited to finally be here, but I am really dreading the post surgical chapter. I know its going to be tough, real tough and I think I'm just in my head to much now that the day i here. Wish me luck, Hopefully I'm one of the lucky ones, and everything goes smoothly. Cant wait to give an exciting update,. If there is anyone else have a June bypass or even a recent one, Id love to have someone to compare war stories with. Also, anyone near San Antonio Tx? See ya soon with the future me. 💜

        I'm in Houston so kind of near you and had the sleeve in Dec. Down 61 lbs. Feeling better. Was definitely worth it. I hope the everything is going well for you. Update us when you can!

        I am back home after my bypass surgery in Tiajuana. I'm post op day 4. Everything went great! I guess I'm one of the lucky ones who have not encountered much pain at all, no nausea thus far and I'm having no problem keeping down broths and water. Thank you for your well wishes. I cant wait to keep up this journey and have a chance at better health and simply better quality of life. I know there will be bumps in the road ahead, and everything won't be peaches and cream, but at least I have a great start so far. 😍

      I am new here today... and only two weeks out from my sleeve surgery on the 23rd. I am amazed I have kept my calories down to 467 today so far... that leaves me almost 750 left for dinner and maybe a snack. This is going to be tough for two weeks... but I have to believe I can do it!

      Hey everyone. I'm new here so I thought I should introduce myself. I am 53y/o and am scheduled for Gastric Bypass on June 25th, 2025. I'm located in San Antonio, Texas. I will be having my surgery in Tiajuana Mexico. I've wanted this for years, but I always had insurance where bariatric procedures were excluded. Finally I am able to afford to pay out of pocket.  I can't wait to get started, and I hope I'm prepared for the initial period of "hell". I know what I have signed up for, but I'm sure the good to come will out way the temporary period of discomfort and feelings of regret. I'd love to find people to talk to who have been through the same procedure or experience before. So I look forward to meeting you all. Hope you have a great week!

        I'm so happy for you! You are about to change your life. I was so glad to get the sleeve done in Dec. I didn't have feelings of regret overall. And I'm down almost 60 lbs. I do feel a little sad at restaurants. I can barely eat half a kid's meal. I get adults meals often because kid ones don't have the same offerings at times. Then I feel obligated to eat on that until it's gone and that can be days. So the restaurant thing isn't great for me. All the rest is fine by me! I love feeling full with very little. I do wish I could drink when eating. And will sip at the end. Just a strong habit to stop. But I'm working on it! You will do fine! Just keep focused on your desire to be different. Not better or worse. But different. I am happy both ways but my low back doesn't like me that heavy. So I listened (also my feet!). LOL! Update us on your journey! I'm not far from you. I'm in Houston. Good luck and I hope it all goes smoothly! Would love to see pics of the town you go to for this. I've never been there. Neat you will be traveling for this! Enjoy the journey. Take it one day at a time. Sometimes a few hours at a time. Follow all recommendations as best you can. 💗

        Thank you so much for your well wishes. I am hoping that everything goes easy for me as well. We don't eat out much as it is, so it wont be too bad in that department. Thankfully. Also, I hear you regarding your back and feet!! I'd like to add knees to the list. Killing me as we speak! I'm only 5' so the weight has to go. Too short to carry all this weight. Menopause really did a doosey on me. (😶lol) My daughter also lives in Houston. with her Husband and my 5 grand-littles. I grew up in Beaumont, so I know Houston well, I will be sure to keep in touch and update you on my journey. I may need some advice in the future, or just motivation.
