Americans with disabilities act (ADAAA) for surgery?

I don't qualify for FMLA at my job because I haven't been there long enough. My HR office suggested I apply for ADA (Americans with disabilities) to ensure my job during the surgery recovery period. Anyone know if this surgery qualifies under this? I couldn't find anything and according to what I read online it looks like the ADA is for people with more permanent issues.

There is really nothing to "apply for" under the ADA. A covered employer (assuming your employer is large enough to be covered( which it sounds like it is, since they are advising you about the ADA) has to grant a reasonable accommodation for your disability. You have to tell them you are disabled and ask for the accommodation.

The ADA defines a person with a disability as a person who has a physical or mental impairment that substantially limits one or more major life activity.

If I were you, I would get a doctors note explaining your medical condition and I would show it to them and ask for an accommodation for your disability (obesity and whatever co-morbidities you have). Explain that the accommodation you want is time off to have this surgery and recover. If they say no, talk to an employment lawyer who handles disability discrimination or your state Protection and Advocacy agency.

      Two months out from hiatal hernia repair.  Surgeon said to expect a lot more flatulence...something about the 'air' no longer being able to 'burp' out so comes out the other end.  That is my experience but have no understanding of why that swallowed air cannot be 'burped'. ???

        As I understand it since your stomach is smaller and not completely resting against your diaphragm anymore you no longer have the ability to "push" burps out as well. Plus, since its smaller and we don't digest slower the trapped air moves a lot quicker out of the stomach so its no longer available to burp out. Hence the other option for removal.

        Me too girl!! Are you in the full liquid diet right now? It’s sooooo hard!

        Not yet. I was told I only have to do 24 hours of a liquid diet. But I have my pre-op tomorrow so I’m going to confirm if I need to do longer.

      Down 33 lbs and slightly stalled, but I'm gonna reevaluate and push through. I started back to work last week after 2 years of being disabled due to mental health as well as my weight. It's a great job and I'm just so happy to have this opportunity at a second chance at life. Hope everyone is having their best journey ❤️ Together, we got this!
