First Denial... how do I appeal this time

Recommended Posts

I am 35 years old. My BMI is 44%, I have co-morbidities but take medications that are successful. I am pre-diabetic, have sleep apnea, and a strong family history of heart disease related to weight.

My question is, how do I appeal again? I wrote the first appeal letter basically saying I have all these co-morbidities and in the long run the weight will kill me. I got denied on appeal. My insurance requires you be 49% BMI for automatic approval without medical conditions, 40% with.

Do I find a lawyer to help write it? Do I write it myself? Do any of you want to share your appeal letters to give me ideas?

Google weight loss surgery appeals lawyers.

I've heard good things about them.

My local bariatric group says to get a lawyer & appeal always. Its cheaper than self pay & you are sure to get coverage if you have complications later. If u give up & go to Mexico you could end up in mucho bills.

Contact obesity law they helped me 5 years ago when my lap band was denied I recently converted to the sleeve and luckily didn't get denied this time. They were great with my lap band appeal I didn't really have to do anything they handled everything and best of all it was at no cost to me.

Also have your primary physican, write a letter on your behalf, if they can show how your health conditions have progressed over they years and can show that will help you long term. With a BMI of 44 you sound like a good candidate.

Two months out from hiatal hernia repair.  Surgeon said to expect a lot more flatulence...something about the 'air' no longer being able to 'burp' out so comes out the other end.  That is my experience but have no understanding of why that swallowed air cannot be 'burped'. ???

As I understand it since your stomach is smaller and not completely resting against your diaphragm anymore you no longer have the ability to "push" burps out as well. Plus, since its smaller and we don't digest slower the trapped air moves a lot quicker out of the stomach so its no longer available to burp out. Hence the other option for removal.

Me too girl!! Are you in the full liquid diet right now? It’s sooooo hard!

      2. LadyVeteran1

Not yet. I was told I only have to do 24 hours of a liquid diet. But I have my pre-op tomorrow so I’m going to confirm if I need to do longer.

Down 33 lbs and slightly stalled, but I'm gonna reevaluate and push through. I started back to work last week after 2 years of being disabled due to mental health as well as my weight. It's a great job and I'm just so happy to have this opportunity at a second chance at life. Hope everyone is having their best journey ❤️ Together, we got this!
