Ok I know I haven't been here that long but I seriously gotta rant here. I HATE and yes I mean hate my ex husband. He's a worthless piece of trash I tell ya. Little bit of history then I'll tell ya what really set me off. I divorced dumbass in 1999 and honestly he wasn't so bad back then. I just couldn't be with him is all. So we have a great kid, Marissa. She's 14 now but she's sick. She has Crohn's Disease and we haven't been able to find a way to control it yet and that's going on 2 years now so she's always miserable. We pulled her outta school b/c there's no way she can go. Anyhow he's always been a dead beat dad. Yeah I get my child support but that's b/c his wages are garnished so he doesn't have to worry about it. I had to file bankruptcy after we were divorced b/c I got nailed with her medical bills and our cc bills. Of course he won't help pay for her meds or bills, oh yeah or any of her schooling. Yes he is court ordered to but the problem is the collection agencies and credit card companies don't give a hoot and there's not alot you can do about it. So last year Marissa got really sick and she had to see a pediatric gastroenterologist (sp?) and her other specialist is a pediatric oncologist/hematologist. Now dipshit has insurance on her but the problem is the only specialists within a 3 hr drive that need to see her are not contracted by his insurance so b/c of her Crohn's Disease I was able to get medicade for her that will pay for most of these bills. So far it's up to 15K that's been turned into collection. I've been fighting with him for over a year to just get me the EOBs from insurance so the docs can turn all of this into medicade but it seems he just wants to be a total dick. If we had those it would be paid, almost all of it. So now they are getting ready to take me to court unless I start paying all of these bills that should be paid anyway. I hate him, i hate him i hate him. Ugh ok sorry it's so long and if ya read it well thanks b/c I know it was a lot to take in. I'm just stuck and pissed.

It would seem that all of this will come up at court. Can't a judge order him to make sure her medical bills get paid, if he has her on his insurance?

Thanks. Well a judge can order him to pay his half but the problem is the collection agencies could care less what a judge says. I've already been that route once before and basically gave 2K to a lawyer to find out it's almost impossible to enforce it.

Well that sucks for sure. The collection agencies should start hounding him instead of you!

Thank you as well and thank you for asking about my daughter. I think her prognosis is fine, from what we can tell she's not in immediate danger but with crohn's it's just unpredictable so we never know what's next with her sickness. If we could just get her into "remission" it would be so much easier but she's pretty miserable on a daily basis. She's on daily meds plus monthly infusions.

she does get a wish granted from the Make A Wish Foundation so that has brought her spirits up alot. now I'm just hoping they can find a way to pull off her wish.....

I would be sure to share all of his contact info with the credit collectors who are after you. But don't give them an of his work phone numbers because you don't want him to lose his job (and insurance and garnishments). They will harass anyone they can get hold of, so I would certainly let them. Good luck to you and your daughter. I believe there is a special place in h _ _ _ for people like your husband.

Hijabi Girl, I am very sorry to hear that you are experiencing such terrible problems and my thoughts are with you. I wish I had some useful advice to offer but sadly I don't.

I sent you a PM about another forum that might be able to give you some help on the bill side of this . I am sure there is something you can do , some kind of letter to send along with a copy of the court orders ect i am just not sure what it is . The bill collectors have to follow a court order , if it says you are not responsible, just as they do with divorces. Granted it is not easy to do , and it will probably take some work. Like i said I just do not know the exact way to go about it . But the Forum link i PMed you someone on there WILL be able to tell you exactly how to go about it.

Sorry to hear about your troubles. I hate my ex too! I'm finally done with him. Our youngest turned 18 in Sept. He's at Navy boot camp now, so I'll have to see jackass Jan 25th at graduation. :-(

I agree with Jack. You should be able to call the insurance company directly and ask them to send you the EOBs. Since your daugther is covered, you have a right to ask for them as her parent.

I'm sorry that you are going through this.... he should take responsability...and I really hope that Marissa gets better! my heart goes out to you.

Oh, tell us what her wish is! I have a friend who is very involved in the Make a Wish organization.

I got a letter today from the Child Support Enforcement Dept. here in Oregon. My boyfriend and I broke up a couple of years ago because he wanted to quit his job so he could stop having his wages garnished.I kicked him out. Now he lives with his Mommy (at 55 yrs of age)

The letter wasn't sealed. It was asking for his address and other information. I am going to call the lady in the letter and give her his Mom's address and telephone #. Like I said, I hate dead beat

Have you contacted Legal Aid? You can file a civil suit against him, in which he has to appear in court to answer why he will not provide the requested and previously court ordered information.

In some states Legal Aid actually assigns you a pro bono attorney for the case, in others one assists you in filing the necessary paperwork to do it yourself.

Once you get that done, and actually appear in court, if they award payment of some of those bills to him, and if you have a joint custody settlement, they should, you will have similar papers to a discharged bankruptcy---and they will hold up with bill collectors.

My oldest DD went through this not long ago. Here, they just advised her, and she took him to court on her own in a civil suit. He went in with an attorney, and my DD still won. She was not asking for anything as a settlement, she just wanted paperwork to present to show responsibility concerning hospital bills, and she wanted an itemization redone of the bills. The judge told him this was a waste of his time, that he was already supposed to be doing this, and he should charge him with contempt!

She has had much steadier payment of CS, and he has picked up on his part of the hospital bills too. Mostly he now knows she is not scared to do what it takes!!!

You also might wanna call your medicaid caseworker and explain the whole thing to them. I don't know if they can do allot. But I do know that if he has insurance that will cover her they will do what they can to shift costs to his insurance.

And I know here you have to contact them first to get through legal aid anyhow.

Next time I go in for my quarterly review I'm sending them after my deadbeat ex. Which they will do so gladly at no cost to me since my kids get medicad.
