BIN and insurance

When I started looking into wls I was 38 bmi and needed two comorbities, which I have diabetes and recently diagnosed with sleep apnea. I am now at 40bmi. My question is does the 40bmi need to be documented for more than a year or does it not matter as long as you always been over 35bmi?
